Terms of Use and Refund Policy
Thank you for your interest in DOCGuard, Inc. (“DOCGuard”, “we”, “or “us”) and our site docguard.io, including app.docguard.io, and our associated applications programming interface(s) (each an ‘API’) and other services (collectively the ‘Service’). These Terms of Service (“Terms”) govern your use and access of the Service, which is provided by us and constitute a legally binding agreement between you and DOCGuard.

By clicking “I ACCEPT,” or by accessing or buying DOCGuard’s products or using the DOCGuard Platform (collectively, “Acceptance”) as free, you confirm that you have read, understood, and, as a condition of your use of the Platform, agree to be bound by the following Terms and Conditions.
These Terms include:
If you submit a PUBLIC sample, you agree that the sample is immediately shared for review by the Service’s Partners, and the resulting report is shared with you and the Partners, which use the results to improve their systems. As such, you are contributing to the effort to raise global IT security levels by contributing a Sample.
While you retain any ownership rights in the original material contained in the Sample, when you upload or otherwise submit a copy of the Sample, you give DOCGuard (and those we work with) a worldwide, royalty free, irrevocable and transferable licence to use, edit, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute all content contained in the Sample.
YOU FURTHER AGREE THAT YOU WILL ONLY UPLOAD SAMPLES THAT YOU WISH TO SHARE PUBLICLY AND THAT IN ANY CASE, YOU WILL NOT KNOWINGLY SUBMIT ANY SAMPLE TO THE SERVICE THAT CONTAINS CONFIDENTIAL OR COMMERCIALLY SENSITIVE DATA OR PERSONAL DATA OF ANY INDIVIDUAL WITHOUT LAWFUL PERMISSION.
If you are not eligible or do not agree to these Terms, you do not have our permission to use the Service. Your use of the Platform and DOCGuard’s Service provision to you signify an agreement between DOCGuard and you to be bound by these Terms.
Arbitration Notice
You consent to resolve disputes arising from these Terms through binding, individual arbitration. By accepting these Terms, you and DOCGuard are both forfeiting the right to a trial by jury or participation in any class action or representative proceeding.
1. DOCGUARD SERVICE OVERVIEW
Our platform empowers you to access cutting-edge malware analysis, document sanitization, and email security solutions.
2. USAGE, ACCOUNT AND REGISTRATION
Registration is mandatory to access the full features provided by DOCGuard. However, you may use a limited version of the Service without registration. During registration, we may request certain information about you, such as your name, email address, and contact details. By registering, you agree that the information you provide is accurate, complete, and not deceptive, and you commit to keeping it accurate and up-to-date at all times.
You will be prompted to create a secure password as part of the registration process. It is your sole responsibility to maintain the confidentiality of your account and password. 3. PAYMENT & PRICES TERMS
Certain functionalities within the Service may necessitate the payment of fees, as outlined on our Pricing Page at https://app.docguard.io/pricing. Distinct features of our Service may be subject to varying pricing structures. Before making any payments, you can review and consent to the associated fees.
Unless explicitly stated in these Terms, all fees are denominated in U.S. Dollars and are non-refundable, except as mandated by applicable law.
3.1 Price
DOCGuard will exert reasonable efforts to ensure the accuracy of pricing information displayed on the Service. We encourage you to periodically review our pricing page for the latest pricing details, or you may contact our sales team for updated information.
3.2 Promotional Offers
At its discretion, DOCGuard reserves the exclusive right to introduce promotional offers with distinct features and pricing structures for various customers. Unless extended explicitly, these promotional offers shall not apply to your request or these Terms.
3.3 Authorization
By utilizing DOCGuard’s services, you grant DOCGuard authorization to process charges for all orders you place and any chosen Service level, as outlined in these Terms or presented by DOCGuard. This includes assessing all applicable taxes, which will be charged to the payment method specified within your account. In cases where you make payments using a credit card, DOCGuard reserves the right to initiate a pre-authorization check on your credit card account before completing your purchase. This pre authorization confirms the validity of the credit card and the availability of sufficient funds or credit to cover the cost of your purchase.
3.4 Payment Process
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. We use STRIPE for the payment process. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so we can complete your transactions and contact you as needed.
3.5 Billing
We will notify you through email and bill you via an online billing account for any purchases made on our website.
3.6 Technical Issues
We use STRIPE to deliver a reliable and high-quality service. But we cannot guarantee the absence of technical issues or interruptions. If there are technical problems, please contact our support team for assistance. However, we do not issue refunds solely based on technical disruptions.
4. SUBSCRIPTION TERMS
These Subscription Terms contain important information about your Subscription and form part of the General Terms. Capitalised terms not defined in these Subscription Terms have the meaning given in the General Terms. The price payable for our Services at the Initial Offers made available to you will only be applicable for the initial term of your Subscription. After the first renewal is due, Your Subscription will be automatically renewed and you will be charged the then-current price for the renewal period. You have the right to revoke the Subscription starting from the next period. We will inform you prior to the automatic renewal.
4.1 Subscription Period
Paid services at DOCGuard are provided within subscription plans. You can choose appropriate initial subscription period when purchasing our services. This initial period will be specified in your purchase confirmation most likely in your email, sent to you after your subscription purchase. You acknowledge and agree that, after any initial subscription term you select, your service subscription will automatically extend for another term of the same length, unless you terminate your subscription before the end of the then-current service term. Note that, if the renewal price of your Subscription Plan has changed since the subscription was originally purchased, you shall be charged the lowest such renewal price when subscriptions renew within the same subscription period. Consent: You express your consent for the automatic renewal of our services.
Confirmation: You confirm your acceptance of the offer to purchase our services.
Agreement: You acknowledge and agree to abide by our Terms and Privacy Policy.
This email confirms our appreciation for your sustainable use of our services through subscription, as the main objective of the renewal process is to prevent interruption of the subscription services thus offered. For any clarification necessary on your end regarding your subscription, its terms and renewal, please feel free to contact us.Your satisfaction and understanding are important to us.
4.2 Automatic Renewal
Auto-renewal. After the end of your first Subscription period, your Subscription will be automatically renewed for an additional term:
1-year and longer Subscriptions: for the 1-year Subscription period annually.
Shorter than 1-year Subscriptions: for the same respective Subscription period each time.
4.3 Receipts and Invoices
We will email you a receipt and the purchase confirmation after you pay for the first Subscription period.
4.4 Subscription Canceled
If you have acquired our Services directly from DOCGuard, you have the option to cancel your Subscription, which involves deactivating auto-renewals for the upcoming Service period, at any time through [email protected]. Please note that canceled Subscriptions will not be eligible for refunds for the unused part of the ongoing Service period. In addition, you are responsible for canceling your subscription before the renewal date if you wish to avoid being charged for the subsequent billing period. However, if you obtained the Services through a third-party provider, the ability to cancel the Subscription is subject to the terms and conditions of that third party.
5. REFUND POLICY
5.1 All Sales Are Final
Unless explicitly stated otherwise in a separate written agreement with DOCGuard, all sales and transactions conducted through our platform/website are considered final, and we do not provide refunds for any reason. For subscription-based Services, you must cancel your subscription before the renewal date if you wish to avoid charges for the subsequent billing period. DOCGuard does not offer refunds or prorated refunds for subscription fees once charged.
5.2 Change of Mind
DOCGuard does not provide refunds due to a change of mind or dissatisfaction with the Services rendered.
5.3 Exceptions
24-Hour Exception: DOCGuard offers a 24-hour refund exception period. Refunds will be considered if the following conditions are met within 24 hours of the transaction:
(i) Your usage of our Services for the specific transaction is less than 50 file analyses.
(ii) You must contact our support team within 24 hours of the transaction.
Legal Requirements:
In cases where applicable laws or regulations necessitate refunds, DOCGuard will comply with those legal requirements.
Fraudulent Transactions: DOCGuard reserves the right to investigate and, at its sole discretion, refund payments suspected of resulting from fraudulent activity.
